Somasphere.art (“Landing Page”) is owned and operated by Rhiyanna Chatta, a California sole proprietor ("Rhiyanna", "We", "Us", “Our,” and/or "Their"). The mysomasphere.practicebetter.io website, app, and health portal and its contents and personal training services (collectively, the "Holistic Portal") is also owned and operated by Rhiyanna and/or Their affiliates and licensors (collectively, "Rhiyanna Affiliates"), and Rhiyanna provides the Holistic Portal to You and any user accessing the Holistic Portal  (the "User", “You”) subject to the Somasphere Terms of Use Agreement, located at https://somasphere.art/terms (the "Terms of Use", “Terms”). The Terms of Use requires You to agree to be bound by the Somasphere Privacy Policy, located at https://somasphere.art/privacy (the "Privacy Policy"). By accessing and/or using the Holistic Portal or the Services (as defined below), or otherwise availing Yourself of the services and information offered through the Holistic Portal, You agree to be bound by the Terms of Use and Privacy Policy in effect at the time of each such access or other use of the Holistic Portal or the Services (as defined below). The Terms of Use and the Privacy Policy applies to You and to any and all entities or Persons (as defined below) on whose behalf You act.

You acknowledge and agree that Rhiyanna may, from time to time, and in their sole discretion, with or without notice to You, modify the Terms of Use and the Privacy Policy. Your access and/or use of the Holistic Portal indicates Your agreement to read and be governed by the Terms of Use and the Privacy Policy. It is Your responsibility to apprise Yourself of any such revision or modifications each time You visit or use the Website or the Services (as defined below). If You do not so agree, You are not authorized to access or use the Holistic Portal or the Services (as defined below) in any manner.

Section 1. - Definitions. As used in the Privacy Policy.

"Services" means, collectively, the portals, programs, memberships, training and/or telehealth sessions, virtual meetings, features, material, and information available on the Holistic Portal, and any other virtual or in-person sessions, tools, and material provided by Rhiyanna to the User.

"User Information" means any information transmitted to or collected by Rhiyanna concerning the User, including without limitation personal information, health-related information, medical records, physical/fitness/movement screening and assessment results, User Submissions (as defined below), and Registration Information (as defined below).

"User Submissions" means any content (including activity logs, audio recordings, code, comments, copy, concepts, data, external links, health logs, ideas, images, information, media, messages, music, photography, programs, test results, text, video recordings, written materials, and/or other materials) that the User uploads, posts, e-mails, messages, submits, communicates through telehealth and/or zoom meetings, or otherwise transfers to Rhiyanna, to the Holistic Portal, or to any other User.

​”Registration Information” means any information collected at the time of purchasing a Service and/or a Subscription to access the Holistic Portal, including without limitation name, date of birth, age, gender, pronouns, address, contact information, and health-related information.

Section 2. - Effective Date.

The initial effective date of the Privacy Policy is January 1, 2024. Unless otherwise stated, all revisions are effective as of the date thereof.

Section 3. - Automatic Data Collection.

When You access the Landing Page and/or the Holistic Portal, Rhiyanna may automatically collect Non-Personal Information about Your visit, including without limitation the following categories of information (collectively, "Automatically Collected Information"):

We may collect information about Your use of the Landing Page and/or the Holistic Portal, such as the pages and materials You access, the amount of data transferred, the links You click, the amount of time You spend viewing each page, and other information about Your interactions with the Landing Page and/or the Holistic Portal, as well as certain standard information that Your browser sends to every website that You visit, including Your Internet Protocol (IP) address, operating environment (such as browser type and version, browser plugins installed, operating system version, regional and language settings, screen size and/or resolution, windows size, and page size), access dates and times, and referring websites.

Like most websites, this Landing Page and/or the Holistic Portal uses Google Analytics (GA) to track user interaction. We use the data from GA to determine how many people are using Our site, how people find and use Our web pages, and to visualize user journeys through the website. Although GA records data, such as, Your geographical location, device, internet browser and operating system, none of this information makes You personally identifiable to Rhiyanna. Your computer’s IP address is also recorded by GA and presents a potential way for You to be personally identified; however, Google does not grant Rhiyanna access to this information. We consider Google to be a third-party data processor. GA makes use of cookies, details of which can be found on Google’s developer guides. Disabling cookies on Your internet browser will stop GA from tracking any part of Your visit to pages within the Landing Page and/or the Holistic Portal.

We may combine demographic information supplied by a user at the time of application with site usage data to provide general profiles, in aggregate non-personally identifiable form, about Our users and their preferences in the content of the Landing Page and/or the Holistic Portal. Section 4. - Children Under Age 13.

located at https://www.somasphere.art/terms. The Landing Page and/or the Holistic Portal are not designed for or marketed to Children, and Rhiyanna does not knowingly collect Personally Identifiable Information from Children.

Section 5. - Information Collection and Use.

Rhiyanna collects information from Landing Page and/or the Holistic Portal Users. In this section of the Privacy Policy, We will describe the type of information We collect and how We use it to provide better services.

1. Online Bookings & Registration

When booking a service through Landing Page and/or the Holistic Portal, users are required to give their contact information (such as name, mailing address, e-mail address and phone number). We also may collect demographic information (such as occupation, company information and areas of interest, etc.). For internal purposes, We use this information to communicate with the person and provide requested services, and, for Landing Page and/or the Holistic Portal users, to provide a more personalized experience on Our Landing Page and/or the Holistic Portal. We use aggregate demographic information about Our audience to improve Our service, for marketing purposes and/or industry reporting purposes.

2. Payments (such as online bookings or application fees)

We collect credit card and other payment information (such as card holder name, credit card number, billing address, credit card security code and expiration date), which is used for billing purposes only, and is not otherwise shared.

3. Surveys

​From time to time We invite users to provide information via surveys. Participation in these surveys is completely voluntary and the User therefore has a choice whether to disclose requested contact information (such as name and mailing address) and demographic information (such as zip code or occupation). 4. Virtual Form Submissions

Rhiyanna receives submissions through forms for the purpose of promoting, developing and furthering Our projects, initiatives and services. These forms collect Personally Identifiable Information and User Submissions. By utilizing, uploading to, and completing the sections of the application form, You acknowledge and accept that you own the rights to the User Information or User Submissions you provide and that User Submissions may be made public. Rhiyanna uses this information for the purpose of evaluating submissions, contacting Persons, and to refine and/or expand Our projects, initiatives and services.

5. Referral Forms

If users, specifically healthcare providers and practitioners, elect to use our referral forms for connecting Rhiyanna with prospective participants, We ask for Personally Identifiable Information about the User and the Person the User is referring to Our services, such as name, phone number, and email address. Users are required to obtain prior permission from the Person being referred to disclose the information requested in the referral form before submitting the referral. Rhiyanna will store and use this information to contact Users and maintain their referral system network. We will also reach out to the Person being referred to discuss their interest in Our services.

6. Communications with Us

We have features that allow Users to communicate with Rhiyanna (such as feedback, FAQ, or contact forms). User Submissions may be made public. Requests for service, support or information may be forwarded as needed to best respond to a specific request. We may retain emails and other information sent to Us for Our internal administrative purposes, and to help Us to serve Users and Persons better.

7. Communications from Us

​In order to best serve Users and Persons, We may send updates that contain important information about our sites and services. We may also communicate with a User to provide requested services and for issues that may arise via email, phone or regular mail.

We may offer Our users the option to receive information about Our company, related initiatives, services and special offerings. Users can choose not to receive these communications.

Section 6. - User Submissions.

Personal Information. User Information and User Submissions are governed by the Privacy Policy. By creating any User Submissions, You acknowledge and agree that such information is non-confidential for all purposes, except as otherwise provided in the Privacy Policy.

All User Submissions. All User Information and User Submissions are automatically shared with Rhiyanna as the primary practitioner providing you access to the Holistic Portal and its related Services. You acknowledge and agree that Rhiyanna may have access to Your User Information and User Submissions at any time. You agree to only share and/or upload information on the Holistic Portal which you grant Rhiyanna access to.

Medical Records & Health Information. The Holistic Portal is operated and provided to you using a HIPAA compliant practice management software. User Information or User Submissions you share and/or upload on the Holistic Portal containing information covered under the Health Insurance Portability and Accountability Act (HIPAA) will be kept confidential between You and Rhiyanna. You acknowledge and agree that Rhiyanna is not liable or responsible for User Submissions and User Information you share with any other User on the Holistic Portal.

Prohibited Submissions. You agree that You are responsible for all of Your User Submissions. You agree that You will not create any User Submissions that:

contain viruses, worms, Trojan Horses, or any other computer code, files, scripts, or programs designed (1) to interrupt, destroy, or limit the functionality of any website, computer software, network, or telecommunications equipment or (2) to collect or mine information about the Holistic Portal, the Services, Rhiyanna, or other Persons or Users;

infringe upon, breach, or violate another Person's or User’s intellectual property rights, contract rights or other rights;

contain personally identifiable information of any other individual unless you have permission from the individual, including, but not limited to, name, phone number, e-mail address, username, password, nickname, website URL, date of birth, or Social Security Number; are inappropriate, including, but not limited to, User Submissions that are obscene, pornographic, sexually-explicit, defamatory, threatening, harassing, abusive, hateful, embarrassing to another Person, solicitations of business, chain letters, or pyramid schemes;

​would give rise to any civil or criminal liability under applicable Laws; and/or are otherwise in conflict with the Terms of Use.

No Third Party Material. You agree, represent, and warrant that all User Submissions that You create will not contain third party copyrighted material or material that is subject to other third party proprietary rights, unless You have permission from the rightful owner of the material (or You are otherwise legally entitled) to create or transmit the material and to grant Rhiyanna all of the license rights granted herein.

License for Submissions. You agree that all User Submissions that You create will be treated as non-confidential and non-proprietary, except as otherwise provided in the Privacy Policy.

Monitoring of User Submissions. Rhiyanna does not have an obligation to assess or guarantee the accuracy or appropriateness of User Submissions, even if Rhiyanna elects, in its absolute discretion, to do so or to attempt to do so from time to time. Rhiyanna is not responsible for any User Submissions or any actions or omissions in response to User Submissions. Rhiyanna may, in its absolute discretion: (i) elect not to post or display on the Holistic Portal any User Submission, and (ii) delete or otherwise remove any User Submissions from the Holistic Portal.

Section 7. - Your Rights.

At any point while we are in possession of or processing your personal data, you have the following rights:

Right of access – you have the right to request a copy of the information that we hold about you.

Right of rectification – you have a right to correct data that we hold about you that is inaccurate or incomplete.

Personally Identifiable Information Use by Rhiyanna. Rhiyanna may use Your Personally Identifiable Information for the purposes for which it was submitted by You to Rhiyanna and for Us to provide the Services to You.

Disclosure to Third Parties. To the extent We deem necessary, Rhiyanna may may share Personally Identifiable Information with others, including partners, affiliates, and providers of Rhiyanna performing services for or on behalf of Rhiyanna. Such services may include communications, database, event management, website services and hosting, mailing, and marketing services. Additionally, Rhiyanna cannot fully ensure that Your Personally Identifiable Information will not be disclosed to third parties. For example, Rhiyanna may be legally obligated to disclose information to the government or third parties under certain circumstances, or third parties may breach or circumvent Our security measures to unlawfully access or intercept transmissions containing Your Personally Identifiable Information, or an error or may occur in the administration of the Landing Page and/or the Holistic Portal. In the event that Rhiyanna needs to investigate or resolve possible problems or inquiries, You authorize Rhiyanna to disclose any User Information to government officials as permitted by applicable Laws.
 

Section 10. - Correction, Updating Information, or Deleting Personally Identifiable Information.

Because Rhiyanna keeps track of past bookings, purchases, and subscriptions, You cannot delete or modify Order Information. You may correct or update Your Booking Information using the tools available on the Landing Page and/or the Holistic Portal, but We may retain copies of previously submitted Booking Information. To correct, update, or delete other Personally Identifiable Information, You may contact Us or use the tools available on the Landing Page and/or the Holistic Portal. Your request must provide sufficient information to identify the User Submissions and the Personal Identifiers contained therein or linked thereto. 

Section 11. - Security.

The Landing Page created using Wix which employs a dedicated team of industry-leading web security professionals, as well as external consultants to maintain the security of Our Landing Page. The team is tasked with maintaining the company’s defense systems, developing security review processes and building a security infrastructure. Wix maintains that Our website comes with HTTPS security protocol and is validated with an SSL certificate, is Level 1 PCI Compliant, GDPR and CCPA compliant, and has ISO 27001 & 27018 Certificates, TLS 1.2, DDoS Protection, Website Security Monitoring, 2-Step Verification, and Centralized Website Security.

Section 12. - Links.

Our Landing Page and/or the Holistic Portal may contain links to other sites. Rhiyanna is not responsible for the privacy practices or content of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each web site to which we may link that may collect personally identifiable information. As well, we are not responsible for the misuse of Rhiyanna’s name, products or services listed on other sites.
